Centralized water requirement and permit applications

Loading clip…

  • Centralized water is one of the main reasons referenced in Pacifico's requirements; they don't have it and have applied for permits.
  • They applied on June 5th for water permits; there will be a contested case hearing with Upper Trinity, with the earliest calendar date of June 16th and most likely placement in September.
  • We need to wait for that and listen to the Upper Trinity; it would not be prudent to settle with them given that they're not done.

Subchapter K authority and regulatory basis

Loading clip…

  • It is so plain in our regulations that they are based on Subchapter K, and Subchapter K possesses special authority in this region.
  • For us to just act like we're any other county that doesn't have that is extremely disappointing and irresponsible.
  • Commissioners have the ability to make subjective decisions based on whether something is going to enhance the quality of life for residents, keep the rural character of the land, encourage recreation, and conserve the quality and quantity of our county's water resources.
